All applicants will be subject to drug and alcohol testing as well as background checks. I understand that my safety and the safety of the public are of primary importance. I understand that I must comply with all FRA Rules and the policies of RRHMA. I understand that freight and passenger crews are expected to ask their supervisor about matters not covered by the FRA Rules and/or the policies of RRHMA. I understand, as an Employee or Volunteer for RRHMA, that prior to the earliest train departure, I can review requirements for the day and clear up any questions I have with my supervisor. I understand that if I violate any of the above rules or requirements, I will not be permitted to work for or volunteer for the Railroad in the future. I also understand that there will be required meetings each year to bring employees/volunteers up-to-date with any changes. I understand that if I do not attend these meetings, I will not be permitted to work or volunteer in the future. (There will be time at these meetings to discuss safety issues and give all employees/volunteers a chance to offer suggestions.)
I, the undersigned, hereby assume any and all risk and liability for losses, damages, expenses, personal injuries and death, which I may suffer or sustain while on the property or premises in Employment or Voluntary Service for Railroading Heritage of Midwest America. I do hereby, for myself, my heirs, executors, administrators, assigns and other persons claiming under or through me, remise, release and forever discharge the Railroading Heritage of Midwest America, its successors and assigns, and its officers, agents and employees, from any and all causes of action, claims, suits, demands, damages, costs, loss of services, expenses, compensation and all consequential damages, which I, or my heirs, executors, or administrators, or other persons claiming under or through me, have or can or may have as a result of any losses, damages, expenses, personal injuries, or death which I, or any persons whomsoever claiming under or through me, may suffer or sustain as a result of my performing Employment or Voluntary Service, or incidental to or appertaining thereto, or while upon, about or in the vicinity of the tracks, trains, facilities, property or premises of the Railroading Heritage of Midwest America in connection therewith, and whether said losses, damages, expenses, personal injuries, or death result in whole or in part from the active or passive negligence of the Railroading Heritage of Midwest America, its officers, agents, or employees, or are otherwise caused.
